Rules verified against CONSAR and IMSS: your regime depends on your first contribution — before July 1, 1997 is Ley 73 (pension with 500 weeks at 60–65), after is Ley 97 (875 weeks required in 2026, rising 25/year to 1,000 in 2031 — note: many Afore sites still show 2025's 850). Without enough weeks, the negativa de pensión (CONSAR procedure) releases your full balance in one payment (the SAR 92 subaccount at 65). From the US: locate via AforeMóvil (works there) or e-SAR, guidance via SARTEL USA and consulates, and the withdrawal in person or via power of attorney issued at your consulate (no apostille); a Mexican bank account with CLABE is required. Taxes: LISR Art. 93-XIII exempts 90 UMA per contributed year (≈MX$10,557.90/year in 2026); on the excess the Afore withholds at an effective rate (Art. 96-Bis/RMF 3.11.2) up to 20%, refundable via the annual return. Inactive accounts of people 70+ move to the Fondo de Pensiones para el Bienestar, but the right to recover them is imprescriptible (IMSS). Does the government keep unclaimed money?
It's never expropriated. At 70+, inactive accounts move to the Fondo de Pensiones para el Bienestar — but your right to recover them never expires.
