They're not the same thing, and confusing them costs workers money. Here's what each includes under the LFT — whether you quit or were fired.
Finiquito: what everyone is owed
The finiquito is what you're owed whenever the job ends — resignation or dismissal. It's your earned-but-unpaid amounts:
- Prorated aguinaldo for the part of the year worked.
- Accrued, unused vacation days.
- Prima vacacional — at least 25% of the vacation pay.
- Any unpaid salary up to your last day.
Key point: the finiquito is not severance — it's your own earned pay. You get it even if you resign.
Liquidación: only for dismissal without cause
If you're fired without justified cause, you're owed the liquidación on top of the finiquito:
- 3 months of salary (the "90 days" constitutional indemnity).
- 20 days of salary per year worked.
- Prima de antigüedad — 12 days of salary per year, with the daily wage capped at twice the minimum wage.
Why the difference matters
Watch out: employers sometimes offer only the finiquito after an unjustified dismissal and call it a full settlement. If you were fired without cause, the liquidación is owed too. The calculator separates the two so you know the full number before you sign.
